RIGL 40-8; TITLE XIX of the Social Security Act

Purpose and Reason:

Effective July 2009, to implement statutory changes in the following basic allowances used in the post–eligibility allocation of income from an institutionalized individual to community dependents: 1) minimum monthly maintenance needs allowance (MMMNA) for a community spouse; 2) the basic allowance for a dependent living with a community spouse; and 3) the excess shelter allowance.

Brief statement of Reason for Finding Imminent Peril:

The emergency promulgation of rules is necessary in order to ensure that Medical Assistance beneficiaries are not denied essential benefits.
